General Terms and Conditions for participation in the competition of DAVID Finest Sports Cars DFSC GmbH and the participating customer
1. subject of the conditions of participation and organizer
These conditions of participation regulate the conditions for participation in the competition as well as any necessary transfer of rights. The description and the procedure of the respective competition are provided within the framework of the respective competition campaign on the homepage of the organizer www.davidsportscars.de/gewinnspiel. The organizer of the competition is DAVID Finest Sports Cars DFSC GmbH, Friedrich-Ebert-Damm 118, 22047 Hamburg, Germany, hereinafter referred to as the organizer. By participating in the respective competition, these conditions of participation are accepted.
2. participation
Participation in the organizer’s competition is free of charge. To take part in the competition, it is necessary to complete the entry form and post it in the box provided for this purpose at the event. Participation is only possible within the participation period. Entries received after the closing date will not be considered in the draw.
Participation in the competition is possible from 27.08.2023, 11:00 am to 27.08.2023, 3:00 pm. During this period, users will have the opportunity to take part in the competition.
3. eligibility to participate
Eligible to participate are natural persons who are resident in Germany and have reached the age of 18. Participation is not restricted to customers of the organizer and is not dependent on the purchase of goods or services. If a participant has limited legal capacity, the consent of their legal representative is required. All persons involved in the conception and implementation of the competition and employees of the organizer and affiliated companies as well as the relatives of such employees and their relatives are not eligible to participate in the competition. Participation with falsified identities or with identities of third parties is not permitted. Only one submitted registration per participant will be entered into the competition. It is strictly forbidden to use multiple addresses or profiles to increase the chances of winning. In addition, the organizer reserves the right, at its own discretion, to exclude persons from participation if there are justified reasons. Such reasons include in particular: – manipulation in connection with access to or implementation of the competition – breaches of these conditions of participation – unfair conduct or – false or misleading information in connection with participation in the competition. If the excluded participant is a winner who has already been drawn, the prize may be subsequently revoked.
4. prizes, prize notification and transfer of the prize
The following prizes will be raffled off among all eligible participants:
Prize 1#: 1x voucher for 500,- Euro on a KW coilover suspension or KW coilover kit (DAVID Sports Cars Sunday), only redeemable at DAVID Finest Sports Cars DFSC GmbH
Prize 2#: 1x Titan Coating elastomer coating of a car worth 400,00,- Euro, valid for 6 months from the date of issue, only redeemable at DAVID Finest Sports Car DFSC GmbH
Prize 3#: 1x day rental for the Porsche Caymann GT4 conversion or similar according to the rental conditions of the organizer in the period 01.05.2024- 01.09.2024 from Monday to Thursday. The voucher can only be redeemed subject to availability and prior registration/booking. Minimum age 25 years, possession of a valid driving license and prior registration/booking. The deposit and all consumption costs (e.g. fuel) are to be paid by the participant. The voucher is valid for a period of 6 months from the date of issue. It is not transferable to other persons. If the person does not meet the necessary requirements, a substitute prize in the form of a DAVID care set will be available.
Prize 4#: 1x voucher for a complete car refurbishment worth 50 euros. The voucher can only be redeemed with the organizer. Furthermore, prior registration and appointment is required. The voucher is valid for 6 months after the date of issue.
Win 5#: 1x value voucher for food & drinks of your choice in the amount of 150,- Euro for the restaurant Claudio’s. The restaurant is located at Tschaikowskyplatz 2, 20355 Hamburg. The voucher can only be redeemed in the restaurant. The voucher is valid for 6 months.
Prize 6#: 1x tire voucher for 4 Goodyear summer, winter or all-season tires
Prize 7#: 6x free oil for your vehicle, on request also High Perfomance 300V redeemable at DAVID Finest Sports Cars DFSC GmbH, Friedrich-Ebert-Damm 118, 22047 Hamburg.
The winners will be determined within 14 days of the closing date for entries as part of a random draw carried out by the event organizer. The participants who are winners of the prize draw will be informed of the prize in a timely manner via a separate e-mail or telephone call. The prize will be handed over exclusively to the participant who has won or to the legal representative of the legally incapacitated participant. It is not possible to exchange, transfer, collect or pay out the prize in cash. Any costs incurred for shipping the prizes will be borne by the organizer. The risk is transferred to the participant when the prize is handed over to a transport person. The organizer is not responsible for delivery damage. Any additional costs associated with claiming the prize shall be borne by the participant who has won. The participant is responsible for any taxation of the prize. If the participant who has won does not respond after two requests to do so within a period of 2 weeks, the claim to the prize shall lapse. In this case, the organizer is entitled to carry out a replacement draw and then transfer the prize to another participant. Only one prize per participant is possible. If circumstances arise for which the organizer is not responsible, the respective participant who has won will accept an appropriate substitute prize. Such circumstances for which the organizer is not responsible are in particular those that lie with the sponsors of the prizes.
5. termination of the competition
The organizer reserves the right to terminate the competition prematurely in whole or in part at any time, even without observing deadlines and without prior notice and without giving reasons, or to change its course if it is not possible for technical reasons (e.g. computer virus, manipulation of or errors in software/hardware) or legal reasons to guarantee a proper and scheduled execution of the competition.
6. data protection
The provision of personal data is required for participation in the competition:
First and last name, e-mail and postal address, telephone number, vehicle details and signature are required. The participant assures that the personal details provided by him/her, in particular first name, surname, e-mail address, postal address and vehicle details, are true and correct.
The organizer is responsible for the collection, processing and use of participants’ personal data. The organizer will only use the participant’s personal details and other personal data in accordance with the statutory provisions of data protection law. The organizer points out that none of the participant’s personal data will be passed on to third parties or made available to them for use without consent.
In the event of a win, the participant who has won voluntarily agrees to the publication of his/her name and place of residence in the advertising media used by the organizer (DAVID Finest Sports Cars DFSC GmbH) (social media, press releases, website www.davidsportscars.de). This includes the announcement of the winner on the organizer’s website and its social media platforms.

7. applicable law
Questions and complaints in connection with the competition must be addressed to the organizer. The organizer’s competition is subject exclusively to the law of the Federal Republic of Germany. Legal recourse is excluded.
8. severability clause
Should a provision of these conditions of participation be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions of these conditions of participation. The invalid provision shall be replaced by a legally permissible provision that comes as close as possible to the economic meaning and purpose of the invalid provision. The same applies in the event of a loophole in these conditions of participation.
