Terms and conditions of the Facebook and Instagram competition with Placek Classics GmbH
- Organizer and duration of the competition
The competition is run by DAVID Finest Sports Cars DFSC GmbH, Friedrich-Ebert-Damm 118, 22047 Hamburg (hereinafter referred to as the “Organizer”). It begins on Tuesday, 01.03.2022 and ends on Sunday, 13.03.2022 at 23.59 hrs.
- Recognition of the conditions of participation
By fulfilling the specified conditions of participation, you agree to the conditions of participation.
- Eligibility to participate
3.1. There is no minimum age limit for the group of participants. Multiple participation is excluded.
3.2. Employees of the organizer and their family members as well as all employees who are or were involved in the creation or processing of the competition and their family members are also excluded from participation.
- Profit
4.1. The following prize will be drawn from all participants:
3x 10% voucher for an After Work Drive (subject to availability)
3x Bespoke Key fob from Hantritt
4.2. A winner will be selected at random from all participants who agree to the conditions of participation. The organizer reserves the right to exclude participants from the competition who have demonstrably registered for the competition more than once through fraudulent attempts.
- Modalities of participation
Participation in the competition is free of charge and takes place exclusively online. Everyone who agrees to the conditions of participation and is eligible to participate by the time described in paragraph 1 will be entered into the competition. The winners will be determined at the end of the competition and notified in writing via Facebook or Instagram.
- Legal process
Legal recourse with regard to the determination of the winners is excluded. No correspondence will be entered into regarding the competition. The competition and the conditions of participation are subject to the law of the Federal Republic of Germany. The place of jurisdiction is Hamburg.
- Handling of the competition
7.1. It is not possible to pay out the prize in cash, exchange it or transfer it to another person. The winner may waive the prize. In this case, another participant will be selected. For this purpose, so-called waiting places will already be determined in the first draw, which will move up in the event of a waiver of the prize.
7.2. The winners will be notified of their prize in writing on the date specified in paragraph 5 and asked for confirmation.
7.3 If the winner does not confirm acceptance of the prize within a period of 24 hours by e-mail to marketing@davidfinestsportscars or by Facebook or Instagram private message, the prize will be forfeited. If the contact details provided are incorrect (e.g. incorrect address), the organizer is not obliged to find the correct address. The announcement of the winner is without guarantee.
Early termination and exclusion of warranty, data protection
The organizer points out that the availability and function of the competition cannot be guaranteed. The organizer is entitled to terminate the competition prematurely if its implementation can no longer be guaranteed for technical and/or legal reasons. Such reasons may include technical problems (viruses in the computer system, manipulation, errors in the hardware and/or software, etc.), changes to the terms of use or other decisions. Participants shall not be entitled to any claims due to premature termination.
Liability
1. the following exclusions and limitations of liability apply to the organizer’s liability for damages, notwithstanding the other statutory requirements for claims.
2. the organizer shall be liable without limitation insofar as the cause of the damage is based on intent or gross negligence.
3. furthermore, the organizer shall be liable for the slightly negligent breach of essential obligations, the breach of which jeopardizes the achievement of the purpose of the contract, or for the breach of obligations, the fulfilment of which is essential for the proper execution of the competition and on the observance of which the contractual partners regularly rely. In this case, however, the organizer is only liable for the foreseeable damage typical for the contract. The organizer is not liable for the slightly negligent breach of obligations other than those mentioned in the preceding sentences.
4. the above limitations of liability shall not apply in the event of injury to life, limb or health, for a defect following the assumption of quality guarantees for the quality of a product and in the event of fraudulently concealed defects. Liability under the Product Liability Act remains unaffected.
5. insofar as the liability of the organizer is excluded or limited, this also applies to the personal liability of employees, representatives and vicarious agents of the organizer.
Data protection information
